Family Visa
The Family Visa Classes are intended to reunite eligible family members with Australian citizens. There is no automatic right for family members of Australians to migrate to Australia however the Australian government has a number of visas that are based on your relationship with an Australian citizen, Australian permanent resident or eligible NZ Citizen. Children
- Child (Subclass 101 & 802) for adopted, biological and some circumstances step-children of Australian citizens, & Australian permanent residents or eligible NZ Citizens.
- Orphan Relative (subclass 837 & 117) this visa is for children that are orphans where applicants are under 18 years of age and parents are either deceased, unknown whereabouts or of unknown whereabouts.
- Adoption (subclass 102) allows the Australian citizen to sponsor a child that is outside of Australia and legally adopted.
- Dependent Child (subclass 445) intended for children of provisional partner visa holders or holders of the subclass 445 visa.
Parents
Parents may be able to migrate to Australia if they have a child in Australia who is a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen. Settled is usually deemed as A person is considered settled if they are an Australian citizen, Australian permanent resident or an eligible New Zealand citizen who is lawfully resident in Australia for a reasonable period. In normal circumstances, two (2) years is considered to be a reasonable period.
Additionally, you must meet the balance of family test ie:
- half your children must be permanently resident in Australia
- you have more children permanently resident in Australia than any other single country.
or
- Parent (subclass 103) for parents of Australian citizens, Australian permanent residents & eligible NZ Citizens.
- Aged Parents (subclass804) for aged parents of Australian citizens & Australian permanent residents & eligible NZ Citizens.
- Contributory Aged Parent (subclass 864 & 884) for aged parents of Australian citizens & Australian permanent residents & eligible NZ Citizens.
- Contributory Parent (subclass 143 & 173) - for parents of Australian citizens & Australian permanent residents & eligible NZ Citizens.
Aged Relatives
- Aged Dependent Relative (subclass 114 & 838) this visa is for applicants that are single, widowed, divorced or separated relatives who can demonstrate they are dependent on an Australian citizen, Australian permanent resident or eligible NZ Citizen.
Other relatives
- Carer (subclass 116 & 838) this visa is intended for relatives of an Australian citizen, Australian PR or eligible NZ Citizens with a medical condition that requires care. The Carer is expected to provide care for the sponsor.
- Remaining Relative (subclass 115 & 835) for the last remaining relative of an Australian citizen, Australian PR or eligible NZ Citizen. If you are married it is important to remember that your spouses family are also considered as relatives.
